Terms of Service

These Terms of Service ("Terms") govern your use of Audimay, a web accessibility auditing platform operated by Neumosys LLC ("we," "our," or "us"). By creating an account or using our services, you agree to these Terms.

1. The Service

Audimay provides automated web accessibility auditing tools. You submit URLs for analysis, and we return audit reports with accessibility findings, severity ratings, and remediation guidance. The service includes automated rule-based checks, AI-powered evaluation, screen reader simulation, and functional flow testing.

2. Accounts

You must sign in with a Google account to use Audimay. You are responsible for maintaining the security of your account. You must not share your account credentials or allow others to access your account. One person or entity per account.

3. Credits and Payments

Credit System

Audimay operates on a credit-based pricing model. You purchase credit packs to run audits. Different audit features consume different amounts of credits. Credit costs are displayed before you run each audit.

Purchases

All credit purchases are processed through Stripe and are billed in US dollars. Prices are listed on our pricing page and may change with notice.

Credit Expiry

Purchased credits expire one year from the date of purchase. Expired credits cannot be recovered or refunded.

Refunds

Credit purchases are generally non-refundable. If an audit fails due to a bug or system error on our end, we will refund the credits consumed by that audit to your account balance. We do not provide monetary refunds for unused credits. Contact us at hello@audimay.com if you believe a refund is warranted.

4. Acceptable Use

You agree not to:

  • Use the service to audit websites you do not own or have authorization to test
  • Submit URLs designed to exploit, attack, or overload our systems
  • Attempt to reverse-engineer our auditing algorithms or AI models
  • Resell audit reports or access to the service without our permission
  • Use the service for any illegal purpose
  • Automate access to the service beyond our provided APIs
  • Circumvent any usage limits, rate limits, or credit requirements

5. Website Content

When you submit a URL for auditing, our service visits and analyzes the publicly accessible content at that URL. You represent that you have the right to have that website audited. We are not responsible for the content of websites you submit for auditing.

6. Audit Reports

Accuracy

Audit reports are generated using a combination of automated tools and AI analysis. While we strive for accuracy, reports may contain false positives or miss certain issues. Audit reports should be used as guidance, not as a definitive legal determination of accessibility compliance. We recommend human review of all findings.

Ownership

You own the audit reports generated for websites you submit. You may use, share, and distribute your reports as you see fit. We retain a license to store and process report data to operate the service.

Sharing

If you share an audit report via a public link, anyone with that link can view the report. You are responsible for managing who has access to your shared links.

7. Intellectual Property

The Audimay service, including its design, code, algorithms, and branding, is owned by Neumosys LLC. These Terms do not grant you any rights to our intellectual property beyond the right to use the service as described here.

8. Disclaimer of Liability for Audit Reports

Audit reports generated by Audimay are informational tools intended to assist with identifying potential accessibility issues. They are not legal advice, compliance certifications, or guarantees of conformance with any accessibility standard, regulation, or law, including but not limited to the Americans with Disabilities Act (ADA), Section 508, the European Accessibility Act, or WCAG 2.2.

Neumosys LLC shall not be held liable for any claims, damages, penalties, lawsuits, or regulatory actions arising from your reliance on audit reports, including but not limited to:

  • Accessibility issues that were not detected or were incorrectly reported
  • Decisions made based on audit findings (e.g., determining a website is compliant)
  • Legal claims brought against you related to website accessibility
  • Financial losses resulting from reliance on audit report accuracy

You acknowledge that automated and AI-powered auditing tools have inherent limitations, including false positives, false negatives, and incomplete coverage of accessibility requirements. A passing audit score does not mean your website is fully accessible or legally compliant. We strongly recommend supplementing automated audits with manual testing by accessibility professionals.

9. Limitation of Liability

To the maximum extent permitted by law, Neumosys LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

The service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless Neumosys LLC from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your audit data will be deleted in accordance with our Privacy Policy. Unused credits are not refunded upon termination.

12. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Wyoming.
